To determine the list of the reporting companies operating in the extractive industries, the Independent Administrator received from the Ministry of Energy of Ukraine a data set with a list of holders of special permits for subsoil use valid in 2024. The set was prepared based on the “The List of special permits for subsoil use (including for oil and gas-bearing subsoil use)”, which was posted by the SGS on the Unified State Open Data Web Portal.
According to the EITI Law, reporting companies are enterprises required to submit a report on payments in favour of the state, namely:
the enterprises operating in the extractive industries.
the parent enterprises in the extractive industries
According to the EITI Law, business entities operating in the extractive industries include individual entrepreneurs or a legal entities operating in the following areas:
geological exploration or extraction of minerals of national importance, sale of extracted products in accordance with a special permit for subsoil use and an agreement on the conditions of subsoil use, or in accordance with a contract (agreement) for subsoil use.
transportation of natural gas, oil and gas condensate by pipelines, including for the purpose of transit.
Business entities operating in the extractive industries also include business entities that are participants in a joint venture agreement, regardless of their ownership of a special permit for subsoil use, which is the basis for the relevant project activities.
Therefore, in line with the meaning of the EITI Law, reporting companies are business entities (individual entrepreneurs and legal entities) that operate in the extractive industries, namely in the field of geological exploration of subsoil, including pilot and industrial development of mineral deposits, or extraction of minerals of national importance, on the basis of the relevant special permits for subsoil use, and/or transportation of natural gas, oil and gas condensate by pipelines, as well as parties to joint venture agreements.
